The access to the Website does not require registration and authentication, but allows you to contact us.

FLUIDINOVA reserves the right to modify the Privacy Policy in accordance with new legislative and/or regulatory requirements, for security reasons and/or for adapting said policy to the guidelines of the supervisory authorities regarding data protection. 2.      What data do we collect, how do we use it and on what basis?

FLUIDINOVA collects several kinds of personal data according to the different purposes below indicated.

Your personal data may be processed for the following purposes:

a)    Creation and management of client’s account: FLUIDINOVA will process the personal data provided to create the client’s account, to identify you, to contact you, and, in general, to manage the client account. Therefore, in case you register on our online store, FLUIDINOVA will collect the following data (i) Email and (ii) Password.

b)   Supply of products:  FLUIDINOVA will process your personal data when that is necessary to prepare, fulfill and execute the agreement concluded between you and FLUIDINOVA, as well as to identify you. In addition, your personal data can be processed to prevent and investigate any incorrect uses of such data.

c)    Development of products and services: FLUIDINOVA may process your personal data for the development of its products. However, FLUIDINOVA will predominantly use aggregated data and statistical information for such purpose. In this scope, we collect information about the computer or device (including mobile devices) that you use to access it, namely your IP address, the website through which you accessed ours, the type and language of your browser, the operating system, cookies, the country from which the access is made, referral and exit pages, URL, platform type, number of clicks made, domain names, landing pages, pages visited, the order of pages accessed, the amount of time spent at each page, the date and time of the visit of our website, access errors and other similar information sent to us by your browser.

d)   Improvement of the provided services: Personal data may be processed for analysis purposes, market studies, quality and satisfaction surveys, and to enhance our interactions.

e)    Communication: FLUIDINOVA may process your personal data to communicate with you, namely to send you any news related to our products and activities, to provide assistance in matters related to customer support, e.g. to respond and handle your requests sent via our customer service channels (contact form available on the Website and email contact), or to confirm or not your application for registration on the Website.

If you choose to request information through the contact form available on our Website, FLUIDINOVA will collect the following data:

                                  iv.       Country;

                                   v.       Email address.

f)    Marketing: FLUIDINOVA may process your personal data for the purposes of marketing, namely to send, information about our company and our activities, new products and relevant updates, marketing campaigns and our Newsletter (in case you authorize it), as well as to send you invitations, by email or by any other equivalent form of electronic communication. You may cancel at any time the subscription of the Newsletter and/or the relevant updates, following the instructions made available in each communication.

If you authorize us, we will use the data you provided in the checkout form when completing a purchase on our online store to send you updates, information, and news about our company, products, activities, and events, as explained above.

FLUIDINOVA does not make automated decisions, including those based on profiles created from the processed data, nor does it engage in profiling.

The legal basis for processing your data is as follows:

  • Client     account, supplying products and communications in order to provide you the     requested information and/or or to confirm or not your application for     registration on the Website and technical communications, particularly related to providing assistance and monitoring the quality of our service: execution of a contract or pre-contractual measures and compliance with legal obligations;
  • Marketing and other forms of communication not included in the previous point: consent, except when legislation permits processing without reliance on consent;
  • development of products and improvement of the provided service: pursuit of FLUIDINOVA's legitimate interests in developing and adapting the products and service provided to customers according to their needs and preferences;
  • Compliance with legal obligations, particularly tax obligations or anti-money laundering obligations.

When the processing of personal data is based on the data subject's consent, the data subject may withdraw it at any time, free of charge, through the contact information provided in point 1 of this policy. The withdrawal of consent does not affect the lawfulness of the processing of personal data carried out prior to the withdrawal.

The data collected when placing an order is necessary for the performance of the respective contract. Therefore, the data subject, does not provide it, FLUIDINOVA will be unable to comply with the contract.

3.      Who are the recipients of your data? 

FLUIDINOVA may engage other companies to the provision of certain services, such as payment management, shipping services, services related to marketing or to the maintenance of the Website and digital suppliers. In these cases, these third parties may need to access to certain information and user data. FLUIDINOVA ensures that these third parties will only have access to the data that is necessary for the execution of the contracted tasks. Moreover, FLUIDINOVA ensures that it has entered into an agreement with such third parties to regulate the protection of personal data, under which said third parties undertook not to disclose the data, by any means, nor to use them for any purposes different from the provision of the contracted tasks.

4.      Where do we storage your data?

FLUIDINOVA adopts the technical, electronic and organizational procedures necessary and adequate to guarantee the security of your personal data and to prevent its loss, misuse or improper access.

We frequently review our data collection, storage and processing policies to ensure that we only collect, store and process information that is essential to the provision or improvement of our services.

We have adopted the appropriate procedures to ensure that your information is accurate, complete and current, but it is your responsibility to update or correct your personal information when necessary.

Since the collection of personal data is made in an open network (internet), these may possibly circulate in the network without security conditions, and may be viewed and/or used by unauthorized third parties, notwithstanding the adoption, by FLUIDINOVA, of adequate safety measures against accidental or unauthorized destruction, and accidental loss, as well as against unauthorized access, modification or diffusion.

5.      For how long do we storage your data?

We only store your personal data for the time necessary to achieve the purpose for which they were collected, to respond to your needs, requests, or to comply with our legal and contractual obligations.

In order to determine the period within which we keep your personal data, we use the criteria below described. In case more than one criterion is applicable, we will keep your personal data in accordance with the criterion that allows the preservation of your personal data for the longest period:

a.               When acquiring products and services, we will keep your personal data for the duration of the term of our business relationship, including any complaints that may arise, as well as for a period of 10 years after its termination, without prejudice to the compliance of legal obligations applicable to FLUIDINOVA that impose a longer period of storage;

b.               When you contact us to ask questions, request information and clarifications, we will keep your personal data for the period necessary to answer your question/provide you with the information and/or clarifications requested;

c.               When you register in our website, we will keep your data until you ask us to delete it, provided that there is no legal basis or legitimate interests for keeping it;

d.               When you consent to the sending of marketing, we will retain your personal data while the purpose that determined the respective collection persists or until you cancel your subscription, with draw your consent or ask us to eliminate your subscription;

e.               Regarding the use of cookies, we will keep them as long as they are necessary to achieve its purposes or until you change your preferences, as detailed in the Cookies Policy;

f.                For the period of time provided by the applicable law;

g.               or until the specific purpose applicable to certain data ceases to exist. 

We may also keep some of your personal data in the extent necessary to comply with our legal obligations, as well as to manage or to enforce our rights, namely by judicial or administrative means.

In case there is a pending judicial process, the applicable period shall be of six months after the adoption of a final decision.

After the expiry of the above-mentioned periods, the personal data will be eliminated in a secure way.

a.               Right to be informed: Our clients have the right to obtain clear, transparent and comprehensive information regarding the way FLUIDINOVA processes their personal data. That is the reason why we provide you with this Privacy Policy and Cookies Policy. 

b.               Right of Access: In addition to the right to be informed, you can access the personal data we process and keep in your regard. In these cases, FLUIDINOVA will provide you a copy of the personal data subject to processing. When you submit a request by electronic means, the information will be provided in an electronic format of common use. 

c.                Right of Correction: You have the right to correct your personal data in case they are incorrect, outdated or if you intend to complete them.

d.               Right to erasure/right to be forgotten: You can request us to delete your data. Nevertheless, please note that this is not an absolute right, as we may have legal grounds or legitimate interests for the retention of your personal data.

e.               Right to object, including to direct marketing actions: You can cancel your Newsletter and/or relevant updates subscription or opt to be removed from our direct communication system at any moment, as well as object to the processing of your personal data. The easiest way to do this is by clicking on the "Unsubscribe" link in any electronic message or communication we send you, but you can also contact us for this specific purpose.

f.                Right to, at any time, withdraw your consent: You can withdraw your consent when it is basis of the lawful processing. The withdrawal of consent does not affect the lawfulness of processing based on consent before its with drawal.

g.               Right to lodge a complaint before the supervisory authorities: If you consider that the processing of your personal data carried out by FLUIDINOVA breaches the data protection legislation, you are entitled to lodge a complaint before the competent supervisory authority (European Data Protection Board europa.eu) that in Portugal is the National Data Protection Commission (“Comissão Nacional de Proteção de Dados – www.cnpd.pt). Please do not hesitate to contact us before lodging any complaint before the supervisory authority.

h.               Right to data portability: You have the right to move, copy or transfer the data that you have provided us from our database to another;

i.                 Right to restriction of processing: You have the right to request the restriction of your data processing in the following situations: if you dispute the accuracy of the data; if the processing is unlawful and you oppose the erasure of the personal data, requesting the restriction of their use instead; if FLUIDINOVA no longer needs the personal data for the purposes of the processing, but the personal data are required by you, or if you have exercised the above referred right to object to processing during the period within which FLUIDINOVA analyses if the legitimate grounds for processing override those of the data subject.

In order to request the exercise of any of the rights listed above, you shall send a communication addressed to the address above referred in paragraph 1., or an email to the email address also above referred. You may as well use this email address in case you want to ask us any questions regarding this Privacy Policy.

We remind you that these rights, like any others, must be exercised by the data subject in a reasonable and good faith manner. If the requests to exercise the rights are manifestly unfounded or excessive, for instance, if you request information in an unjustified and repeated way or abuse the right to receive information, namely by providing false or misleading information, FLUIDINOVA reserves the right to charge a reasonable fee taking into account the administrative cost of providing information or not following up on the request.

7.      Warranties and warnings 

The data subject guarantees that the personal data communicated to FLUIDINOVA are accurate and precise, undertakes to notify FLUIDINOVA of any change or modification to said data, and assumes sole responsibility for the losses and damages caused by the erroneous, inaccurate or incomplete communication of the data.

The data subject is hereby expressly warned that when disclosing personal data in FLUIDINOVA’s public media, such as Facebook, X, LinkedIn and YouTube, this information may be seen and used by third parties.
